Collaborative Practice Bill Update HB 599, SB 1094

Our collaborative practice bill has been filed by Senator Manny Diaz and Representative Ana Marie and is entitled Consultant Pharmacist. We are including the Physician talking points AND the Legislator talking points. We are focusing on the Senate. We request all pharmacists start a dialogue with Physicians and C-Suite about these bills. 

 

Pharmacy Benefit Manager (PBM) Update HB 961, SB pending

Representative Jackie Toledo has filed HB 961. Talking points to follow once Senate bill is available. 

 

Automated Dispensing Cabinets Update (www.medavail.com)  HB 0059, SB 0708

This bill is gaining popularity with the retail chains. We oppose the bill because it allows placing these machines anywhere in the community without restrictions; and allows non-Florida pharmacists to remote into the dispensing cabinets for counseling.

 

January Legislative Grass Roots Activities

  • We have identified constituents of all the Senators on the Health Care Committee except Senator Janet Cruz from Tampa. Please let us know if you know her.
  • Still looking for contacts for Dr. Rudolph Moise, Dr. Sergio Seoane, and Dr. James St. George. Please contact tamekia@fshp.org if you know these physicians.  
  • We will be offering a 1-hour CE Webinar on Advocacy 2020 in January.
  • Florida Senator letter writing/email campaign January 20-31. Please ask physicians for their support too. Letters can be scanned in and emailed. See document for Senators on Health Committee and contact info.
  • Florida Pharmacist Legislative Days will be held in collaboration with the Florida Pharmacy Association on January 21-22, 2020 in Tallahassee. Please bring your white coats! 

 

Board of Pharmacy Update - December 3-4

FSHP Is committed to having a presence at every Board meeting and reporting back to members. Below are notes from the last meeting.

 

64B16-27.830 Prescriber Care Plan 

A Georgia law firm asked the Board of Pharmacy to amend the above rule above known as Standards of Practice – Drug Therapy Management by adding Physician Assistants ( PA’s ) and Advanced Practice Registered Nurses (APRNs) to the current list of Providers who are permitted to issue a Prescriber Care Plan to a Pharmacist. 

According to the Board of Pharmacy Counsel, the prescriptive authority comes from FS 465.003 (13) and only references Physicians, Podiatrists, Dentists and PAs. It was concluded that a legislative change would be required to allow APRNs to be included. Therefore, APRNs are not permitted to issue a Prescriber Care Plan to a Pharmacist.

There was also discussion that the Board may accept an out of state training technician program through a petition for a variance by a pharmacy technician.
