Filling Prescriptions in Times of Emergencies
  1. Emergency prescription refill (For full statute refer to statute465.0275)
    1. In the event of an emergency order or proclamation of a state of emergency declared by the Governor, executive order may authorized the pharmacist to dispense up to a 30-day supply
      1. No emergency fills for Schedule II drugs.
      2. The dispensing pharmacist must create a written order containing all of the prescription information required and signs that order.
      3. The dispensing pharmacist must notify the prescriber of the emergency dispensing within a reasonable time after such dispensing.
    2. Insurance payment for emergency refills (For full statute refer to statute: 252.358)
      1. Health insurers must waive time restrictions on prescription medication refills, which include suspension of electronic "refill too soon” edits to pharmacies, to enable the refill of prescriptions in advance, if there are authorized refills remaining.
      2. Health insurers must authorize payment to pharmacies for at least a 30-day supply of any prescription medication, regardless of the date upon which the prescription had most recently been filled by a pharmacist, under the following conditions:
        1. The patient resides in a county that:
          1. Is under a hurricane warning issued by the National Weather Service;
          2. Is declared to be under a state of emergency in an executive order issued by the Governor; or
          3. Has activated its emergency operations center and its emergency management plan.
        2. The refill is requested within 30 days after the origination date of the conditions above or until such conditions are ended. 
        3. The time period for the waiver of prescription medication refills may be extended in 15- or 30-day increments by emergency orders issued by the Office of Insurance Regulation.

      1. An institutional pharmacy located in an area under emergency order or proclamation of a state of emergency declared by the Governor may dispense prescriptions to individuals who are not patients of that institution.
